The Austin “Notice of Proposed Eviction” is an untried, untested ordinance that extends the period before a Notice to Vacate for tenants who have not paid their rents or have violated their leases. It would be the first law of its kind in Texas enacted that doesn’t require pandemic-related justifications or reasons. It conflicts with existing legal protections outlined in the Texas Property Code for renters facing eviction.

How does this ordinance affect our renters and taxpayers?

This ordinance will cause a chain reaction of unintended consequences – it will mean additional costs to renters and taxpayers which could lead to a loss of rental housing. This ordinance just puts renters further behind without any real solutions and would lead to increases in rent, further exacerbating the City’s affordability challenge. The 500,000+ renters in Austin need more meaningful outcomes.
